The Canadian Government has launched a new pilot project for international students whose study permit applications have been rejected by IRCC. This project is called the Study Permit Pilot Project and it was launched on 1st October.

Though it was always an option to appeal for a reconsideration of the rejected study permit application, students will now benefit from reduced wait times. Earlier, it would usually take between 14 to 18 months for the whole process to unfold and students had to wait all this time for the final decision. 

However, since the launch of the Study Permit Pilot Project, the wait time has reduced considerably to as low as 5 months. To benefit from this, the student must have new evidence that goes against the rejection of their study permit and they have to apply within a certain period. 

If the student is in Canada, they have 15 days to apply to the Study Permit Pilot Project, and 60 days if they are applying from outside Canada.

Who can apply to the Study Permit Pilot Project?

To be eligible to apply for a reconsideration, the student and IRCC have to agree to participate in this. The student has to meet other requirements as well:

  1. They must have received a letter of refusal
  2. Both student and IRCC must present the entire reason of the decision
  3. The facts of the case must be presented- this means the student must present the initial permit application or the refusal letter, or they may present both
  4. The application should not need to extend time to file for the Leave Application
  5. The student and the IRCC must not use any affidavit evidence 

Do you need to pay a fee?

The applicant does not need to charge additional fees. However, they still need to pay CAN $50 to file for a leave and judicial review.
