This undertaking is on the basis of a contract, which is, no doubt, legal in form. The sponsor puts their signature on the contract, which means they are taking on all of the responsibilities for the common-law partner, dependent spouse, child/children, grandparent/parent.

A sponsorship default happens when the sponsor breaches the obligations or fails to fulfill any required obligations. These obligations could be both financial or non-financial.

Consequences of Sponsorship Defaulting

Let’s see what are the consequences of a sponsorship default for the sponsor. The penalties depend on each individual case.

For example, if the sponsor has to cover any costs related to social assistance but they failed to do so, then, the Canadian sponsor will not be able to act as a sponsor. This will continue until the debt is paid. Only after paying the debt can they sponsor another dependent.

One can also take legal action against their sponsor if they fail to meet sponsorship requirements. In this case, the primary sponsor as well as co-signer(s) may face legal consequences.
